MYDX Terms and Conditions of Uses

These Terms and Conditions of Use govern the use of MYDX website, as well as any content, features, tools, or services offered by MYNIC through the website or via any other means of access.

By accessing and/or using MYDX, you agree to be bound by these Terms and Conditions of Use, which may be updated by MYNIC from time to time. Your continued use of MYDX constitutes your acceptance of any changes made to these Terms and Conditions of Use.

1. Access to MYDX

   MYNIC grants you a limited, non-exclusive, non-transferable, revocable license to access and use MYDX solely for your own personal use. You may not use MYDX for any other purpose, including commercial purposes, without obtaining a prior written consent from MYNIC.

2. Registration and User Accounts

   In order to access certain features of MYDX, you may need to register for a user account. You agree to provide accurate, complete, and current information when registering for a user account, and to update your information as and when necessary to keep it accurate, complete, and current. You are solely responsible for maintaining the confidentiality of your user account login credentials, and for all activities that occur under your user account.

3. User Content

   MYDX allows you to post, upload, publish, or submit content, which includes but not limited to text and images. You retain all ownership rights in any content that you submit to MYDX, but you grant MYNIC a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and publicly display your content, in whole or in part, in any format or medium now known or later developed.

   You represent and warrant that you have all necessary rights and permissions to submit your content to MYDX, and that your content does not violate any laws or infringe upon the rights of any third party. MYNIC reserves the right to remove any content that it deems inappropriate or objectionable, in its sole discretion.

4. Prohibited Conduct

   You agree not to use MYDX for any unlawful purpose, or to engage in any conduct that would constitute a violation of any applicable law, regulation, or third-party rights. You further agree not to:

   1. Post, upload, publish, or otherwise submit any content that is defamatory, obscene, pornographic, or otherwise objectionable.
   2. Use MYDX to harass, stalk, or intimidate any person, or to engage in any other conduct that is abusive, threatening, or harmful.
   3. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity.
   4. Use any automated means, including but not limited to bots, spiders, or scrapers, to access MYDX or collect any information from MYDX.
   5. Introduce any viruses, Trojan horses, worms, or other malicious code into MYDX, or use MYDX in any manner that could damage, disable, overburden, or impair MYDX or any servers or networks connected to MYDX.
   6. Engage in any conduct that could interfere with the proper functioning of MYDX, or that could disrupt or compromise the security of [Platform Name] or any user's account.

5. Intellectual Property

   MYDX and it’s content, features, tools, and services offered through MYDX, including but not limited to all text, graphics, logos, images, audio and video clips, software, and code, are the intellectual property belonging to MYNIC. MYNIC will retain all Intellectual Property Rights in MYDX. These rights are protected by copyright, trademark, and other intellectual property laws.

   You may not reproduce, modify, distribute, display, perform, or otherwise use any of the content, features, tools, or services offered through MYDX without the prior written consent of MYNIC.

6. Disclaimers and Limitations of Liability

   MYDX is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.

   MYNIC does not warrant that MYDX will be uninterrupted or error-free, or that any defects will be rectified. MYNIC shall not be liable to the user for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of MYDX, including but not limited to damages for loss of revenue or loss of goodwill, lost profits, lost data, or business interruption, regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

7. Indemnification

   You agree to irrevocably and unconditionally indemnify MYNIC, its affiliates, and their respective directors, officers, employees, and agents, from and against any and all costs, claims, liabilities, damages, losses, expenses, and fees arising out of or in connection with your use of MYDX.

8. Governing Law and Jurisdiction

   These Terms and Conditions of Use shall be governed by and construed in accordance with the laws of Malaysia, without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with these Terms and Conditions of Use shall be resolved exclusively in the state or federal courts located in Malaysia, and you hereby consent to the jurisdiction and venue of such courts.

9. Miscellaneous

   These Terms and Conditions of Use constitute the terms of use with respect to MYDX, and supersede all prior communications and proposals, whether oral or written, with respect to MYDX. If any provision of these Terms and Conditions of Use is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any provision of these Terms and Conditions of Use shall be deemed a further or continuing waiver of such provision or any other provision.

You represent and warrant that you are at least 18 years old and have the legal capacity to understand the Terms and Conditions of Use. If you are using MYDX on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms and Conditions of Use.

You acknowledge that you have read these Terms and Conditions of Use, understand them, and agree to be bound by them. Continued usage of MYDX constitutes acceptance and agreement to the Terms and Conditions of Use.
